An attorney submitted a cure-and-correct demand on May 15, 2026, alleging violations of California’s Brown Act in connection with actions that culminated in the Pasadena Unified School District Board of Education’s approval of Resolution 2852 on Dec. 11, 2025.

According to a message from the Board President, the District’s legal counsel reviewed the allegations and concluded that members of the Board of Education did not violate the Brown Act.
In its response, legal counsel stated that the Brown Act allows board members to communicate outside public meetings, provided that a majority of the board does not exchange comments or positions on a specific issue. Because the Board consists of seven members, up to three members may engage in such discussions outside a public meeting.
Counsel found that the evidence did not support the allegation that four or more board members exchanged comments or positions on the same topic outside a board meeting. Based on that review, counsel concluded that no Brown Act violation occurred.
The response does not necessarily resolve the matter. It remains unclear whether the individual who submitted the cure-and-correct demand will pursue further legal action.
I was quite upset that this message came from Fredricks. She is one of the accused and shouldn’t be the voice excusing the behavior to the public. It felt immensely disrespectful for her to be the one to send this message, it felt like excusing her behavior. The complete lack of acknowledgement as to why the public has lost trust in her is so frustrating,
